Account Creation

Prohibited Uses

• • Illegal activities or promoting illegal content
• • Harassment, abuse, or discrimination
• • Spreading malware or harmful code
• • Attempting to breach security measures
• • Impersonating others or misrepresentation
• • Collecting sensitive personal data without consent
• • Gambling or unauthorized prize distributions

Subscription Plans

• • Billing occurs in advance on monthly or annual basis
• • All fees are exclusive of applicable taxes
• • Prices subject to change with 30 days notice
• • No refunds for partial months or years
• • Automatic renewal unless cancelled

Enterprise Agreements

• • Custom pricing based on usage and features
• • Net 30 payment terms for qualified accounts
• • Volume discounts available
• • Custom SLAs and support terms
• • Annual contracts with negotiated terms

Our Property

• • Yak Interactive platform and technology
• • All software, designs, and documentation
• • Trademarks, logos, and brand elements
• • Proprietary algorithms and methodologies

Your Content

• • You retain ownership of content you create
• • Grant us license to host and display content
• • Responsible for obtaining necessary rights
• • Warrant content does not infringe rights
• • We may use aggregate data for improvements

Data Handling

• • Compliance with GDPR and privacy laws
• • Data processing per our Privacy Policy
• • SOC 2 Type II certified operations
• • Encryption of data in transit and at rest
• • Regular security audits and assessments

Your Obligations

• • Obtain consent for participant data collection
• • Comply with applicable privacy laws
• • Provide privacy notices to participants
• • Handle data according to regulations
• • Report any data breaches immediately

Termination Rights

• • Either party may terminate with notice
• • Immediate termination for Terms violations
• • Account suspension for suspicious activity
• • No refund for terminated accounts
• • Data export available for 30 days post-termination

Effect of Termination

• • Access to Service immediately ceases
• • License to use platform revoked
• • Obligation to pay outstanding fees remains
• • Sections on IP, liability, and disputes survive
• • Data deletion per retention policy

Service Provided "As Is"

• • No warranty of uninterrupted service
• • No guarantee of error-free operation
• • Content accuracy not guaranteed
• • Third-party integration limitations
• • Compatibility not guaranteed for all devices

Limitation of Liability

• • Not liable for indirect or consequential damages
• • Total liability limited to fees paid in last 12 months
• • No liability for user content or actions
• • Force majeure events excluded
• • Some jurisdictions do not allow limitations

You agree to indemnify and hold harmless Yak Network, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of:

Applicable Law

• • Governed by laws of Delaware, USA
• • Exclusive jurisdiction in Delaware courts

Dispute Resolution

• • Binding arbitration for unresolved disputes
